AMTA 3G Lookup Service – Terms & Conditions

Please read the Terms and Conditions below (‘Agreement’) in relation to your use of the 3G functionality IMEI lookup service (‘3G Lookup Service’) administered by the Australian Mobile Telecommunications Association Limited (‘AMTA’).

1. 3G Lookup Service

1.1 Each mobile device has a unique 15-digit serial number known as an International Mobile Equipment Identity (‘IMEI’) . The device manufacturer and model is the first eight digits of the 15 digit IMEI number known as the Type Allocation Code (‘TAC’).

1.2 AMTA administers a database, compiled and audited by each of the Australian Mobile Network Operators, which contains a list of makes and models of devices that will be supported by all three Mobile Network Operators after the closure of the 3G networks in Australia and their corresponding TACs (‘3G Database).

1.3 The 3G Lookup Service grants a limited licence to members of the public, on the terms and conditions of this Agreement, to perform a ‘lookup’ search in respect of the 3G functionality status of a mobile device after the closure of the 3G networks in Australia, by reference to its IMEI, as recorded in the 3G Database.

1.4 You acknowledge that:

1.4.1 the results obtained from the 3G Lookup Service reflect the status of a mobile device connected with an IMEI as recorded in the 3G Database at the time of the ‘lookup’;

1.4.2 the 3G Database may not be an accurate record of the 3G functionality of a mobile device as at the time an IMEI ‘lookup’ is made, as the 3G Database relies upon data being input and confirmed by the Mobile Network Operators;

1.4.3 AMTA is merely relaying information received from those third parties and has no role in compiling the data within the 3G Database; and

1.4.4 as such, AMTA makes no representation as to the accuracy of the 3G Database or the results returned from the 3G Lookup Service.

2. Licence

AMTA grants you, and you accept, a single non-exclusive non-transferable ‘one use’ licence, on the terms and conditions of this Agreement, to access and use the 3G Lookup Service (‘Licence’).

3. Use of 3G Lookup Service

3.1 You must only use the 3G Lookup Service for personal use.

3.2 You must not use or make use of the 3G Lookup Service in connection with any other products or services.

3.3 Other than as required by law, you must not provide or disclose any part of the information obtained from or in connection with the 3G Lookup Service to third parties other than your mobile service provider.

3.4 You must not misrepresent your rights under this Agreement or use the 3G Lookup Service in any way that is or may be false, misleading or deceptive.

3.5 The 3G Lookup Service has been implemented in a technical environment designed to provide availability to the public and be reasonably fault tolerant. However, as with any technical system, the 3G Lookup Service may not always work as described and may be subject to interruption or breakdown for a wide variety of reasons. You acknowledge and agree that your use of the 3G Lookup Service is on an ‘as is, as available’ basis only.

3.6 AMTA may alter or, for any reason, suspend the 3G Lookup Service at any time without prior notice to you.

4. Termination

4.1 The terms of the Licence continue until terminated by AMTA.

4.2 AMTA may, in its sole discretion, suspend access to and use of the 3G Lookup Service by you, for so long as AMTA determines without prior notice to you.

4.3 AMTA may terminate this Agreement for any reason and without fault on your part at any time and without notice.

5. Disclaimer and limitation of liability

5.1 To the extent permitted by law:

5.1.1 the 3G Lookup Service is provided “as is” without any warranties, expressed or implied;

5.1.2 AMTA does not make any guarantees about the 3G Lookup Service, including but not limited to, implied warranties of merchantability and fitness for a particular purpose;

5.1.3 while we strive to ensure smooth and uninterrupted service, AMTA cannot promise that your access or use of the 3G Lookup Service will always be uninterrupted or error-free. We also cannot guarantee that any defects will be fixed or that the service or server is free of viruses or other harmful components;

5.1.4 we do our best to keep the 3G Lookup Service accurate, up-to-date, and reliable, but AMTA cannot warrant that it is always correct, complete, or free of errors or malfunctions;

5.1.5 you are responsible for how you use the 3G Lookup Service, and AMTA cannot take responsibility for any risks you assume in doing so; and

5.1.6 AMTA is not liable for any loss or damage you may experience that is directly or indirectly related to the 3G Lookup Service, no matter the cause (including negligence).

5.2 AMTA will not be liable for any indirect, incidental, special, or consequential damages or loss of profits that result from your use of or inability to use the 3G Lookup Service (including as a result of any acts or omissions by AMTA).

5.3 To the extent allowed by law, if there is a breach of any implied warranty or condition that cannot be excluded, AMTA’s liability is limited at AMTA’s option to (i) re-supplying the services; or (ii) paying the cost of re-supplying the services.

6. Your Liability to AMTA

You are liable to AMTA for breach of this Agreement or negligence under the principles applied by the courts with jurisdiction over your use of the 3G Lookup Service.

7. Governing Law and Jurisdiction

7.1 The Laws of New South Wales govern this Agreement.

7.2 The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

8. Definitions

8.1 In this Agreement, unless the context indicates otherwise, any term defined below has the meaning so defined.

8.2 Mobile Network Operators means:

8.2.1 Telstra Group Limited ABN 56 650 620 303;

8.2.2 Singtel Optus Pty Limited ABN 90 052 833 208; and

8.2.3 TPG Telecom Limited ABN 76 096 304 620.

8.3 3G Lookup Service means the website located at:

8.3.1 www.3Gclosure.com.au; or

8.3.2 such other location as AMTA may host the 3G Lookup Service from time to time.
